By accessing or using this website, you agree to these Terms. If you do not agree to these Terms, please do not use the website.

We may restrict access to the website or particular features when reasonably necessary to protect the website, our business, our customers, or others.
3. Rental Reservations and Services
These Terms govern use of the website. They do not replace the terms that apply to a Tote the Load rental.
When reservations become available, rentals may be subject to additional terms and policies, including the applicable:
-
Rental Agreement
-
Cancellation and refund policy
-
Service-area requirements
-
Rental period and extension rules
-
Delivery and pickup requirements

Fees and charges disclosed during the reservation process
Where a Rental Agreement applies to a reservation, the Rental Agreement governs the rental relationship and use of Tote the Load equipment.
Information displayed on the website is intended to help customers understand our services, but the terms presented and accepted as part of a particular reservation govern that transaction.
4. Eligibility
Rental services are intended for adults who are legally able to enter into an agreement.
If you make a reservation or enter into an agreement with Tote the Load, you represent that the information you provide is accurate and that you have authority to enter into the transaction.
5. Website Information and Availability
We try to keep information on the website accurate and current. However, website content may occasionally contain errors, omissions, outdated information, or technical problems.
Service availability may depend on factors including:
-
Rental dates
-
Equipment availability
-
Delivery and pickup location
-
Service-area eligibility
-
Operational capacity
-
Weather, road, or safety conditions
-
Other circumstances affecting our ability to provide service
Displaying a package, date, price, service area, or other information on the website does not by itself guarantee availability.
A reservation is not confirmed until the applicable reservation process has been completed and confirmation has been provided.
6. Pricing and Website Errors
We may correct typographical, technical, pricing, or other website errors when discovered.
If an error materially affects a pending reservation or transaction, we may contact the affected customer to explain the issue and determine the appropriate next step consistent with applicable law and the terms governing that transaction.
Nothing in this section is intended to limit rights or remedies available to customers under applicable law.
7. Intellectual Property
Unless otherwise stated, the website and its original content, branding, graphics, written materials, organization, and other materials created by or for Tote the Load are owned by Tote the Load LLC or used with permission.
This includes Tote the Load branding and original materials associated with the Organizational Moving System.
You may view and use website materials for ordinary personal purposes related to evaluating or using Tote the Load's services.
You may not reproduce, distribute, sell, republish, commercially exploit, or represent Tote the Load's original materials as your own without permission, except where permitted by law.
References to third-party products, brands, services, or trademarks remain the property of their respective owners.
8. Third-Party Services and Links
The website may use or link to third-party services, including website hosting, payment processing, maps, analytics, social media platforms, or other online services.
Tote the Load does not control independent third-party websites or services and is not responsible for their content, availability, security, or privacy practices.
Your use of a third-party service may be subject to that provider's own terms and policies.
9. Privacy
Our collection and use of personal information through the website is described in our Privacy Policy.
By using the website, you acknowledge that information may be processed as described in that policy.
10. Communications
If you provide contact information to Tote the Load, we may use it to respond to your request or communicate with you regarding services, reservations, deliveries, pickups, account matters, or other business-related matters.
If you separately choose to receive marketing communications, you may unsubscribe from promotional emails using the unsubscribe method provided in those communications.
Service-related communications may still be sent when reasonably necessary to fulfill or manage a service you requested.
11. Website Availability
We may modify, suspend, maintain, or discontinue portions of the website or its features from time to time.
We do not guarantee that the website will always operate without interruption, delay, or technical error.
Temporary website problems do not automatically modify or cancel an existing rental agreement or other obligation that has already been established between a customer and Tote the Load.
12. Disclaimer
The website and its content are provided for general informational and business purposes.
To the extent permitted by applicable law, the website is provided on an “as available” basis. We do not guarantee that website content will always be complete, error-free, uninterrupted, or suitable for every particular purpose.
Nothing on this website constitutes legal, financial, insurance, moving, or other professional advice.
Nothing in these Terms excludes warranties, rights, or protections that cannot legally be excluded under applicable law.
13. Limitation of Liability
To the extent permitted by applicable law, Tote the Load LLC will not be liable for indirect, incidental, special, consequential, or similar damages arising solely from access to, inability to access, or use of this website.
This website-specific limitation does not replace or modify liability provisions contained in an applicable Rental Agreement.
Nothing in these Terms is intended to exclude or limit liability where doing so would be prohibited by applicable law.
14. Changes to These Terms
We may update these Terms from time to time as our website, services, or business practices change.
When changes are made, we will update the “Last Updated” date shown at the top of these Terms.
Changes apply prospectively to use of the website after the updated Terms become effective. Changes to these website Terms do not retroactively modify a separate Rental Agreement that has already been entered into unless permitted by that agreement and applicable law.
15. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles, except where applicable law requires otherwise.
These Terms do not limit any rights or protections available to consumers under applicable law.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
17. Entire Agreement Regarding Website Use
These Terms, together with the Privacy Policy and any other policies specifically applicable to use of the website, constitute the agreement between you and Tote the Load regarding use of the website.
Separate agreements, including the Rental Agreement, may govern individual reservations, rentals, or other transactions.
